1. Acceptance of Terms By Applying for hosting at XMGFree.com, I, the user, agree to abide by the rules and regulations that are set by the staff, of XMGFree.com and XMGNetworks.com, in this Terms of Service Document. The Staff of XMGFree.com and XMGNetworks.com reserve the right to change this document at any given point in time without giving any form of notification to the users and members of XMGFree.com.
2. Description of Service XMGFree.com is a Subsidy of XMGNetworks.com. This service provides high Quality Free Website Hosting high to registered members of the service. Registered members of this service will be provided with a Free Web Hosting package which is determined by the staff of XMGFree.com and XMGNetworks.com. This package is subject to a change in resources or conditions at any given point in time. XMGFree.com will make every possible effort to stay up as long as possible, and at a time that funds for the service run out, XMGFree.com, XMGNetworks.com or any other subsidy/affiliate of XMGNetworks cannot be held responsible or liable for any potential data loss, personal damage, financial loss or damage to commercial activities that result from an inability to provide the service.
3. Registration Duties When filling out a registration application, users are expected to give accurate and true information. Any member of the XMGFree.com Staff or XMGNetworks.com Staff who believes that false, inaccurate or deceiving information has been provided, reserves the right to reject the application.
4. Account Terms All registered users of XMGFree.com must abide by the Terms of Service, Disclaimer and Forbidden Files as agreed upon during their registration process. The Staff of XMGFree.com and XMGNetworks.com reserve the right to terminate the account of any user who they feel is not applying themselves to the task of stopping any activities that are not permitted by the Terms of Service Document and/or Forbidden Files Document. Users Register with the prior knowledge that the Staff, who have been granted permissions necessary, will have full access to their data and files that are stored on our server. In the unfortunate event of data loss, due to these Permissions given to staff, XMGFree.com, XMGNetworks.com and any other Subsidy/affiliate of XMGNetworks.com cannot be held liable.
5. Privacy XMGNetworks.com and XMGFree.com expect all members to keep passwords and usernames confidential and not available for public use and/or distribution. XMGNetworks.com and XMGFree.com also expect members to keep all IP Addresses, SSL Certificates and other Potentially Confidential Information confidential.
6. Our Promise XMGFree.com and XMGNetworks.com staff Promise to continue this service for as long as possible. However, we reserve the right to modify, discontinue and/or restrict this service at any given point in time with no prior notification to users.
7. Termination XMGFree.com and XMGNetworks.com reserves the right to discontinue any account that they feel is not upholding this contractual agreement, or any account who they feel is not being productive. There will be a server prune approximately every month. The accounts to be pruned will be posted on the forum for a week before they are terminated. If the user of the account does not reply to the post, their account will be terminated. Deep prunes will also happen every once in a while, and there may or may not be a warning.
8. Resale of Service By accepting our Hosting, the user agrees to not duplicate, imitate, reproduce, resell or exploit our services. Any user caught doing this will have their account removed instantly.
9. Netiquette Registered Hosting Users, Forum Members, IRC Users and Visitors of XMGFree.com and XMGNetworks.com are expected to show curtosey, supportive behaviour and demonstrate a controlled use of fowl and/or demeaning language. Staff Members Reserve the Right to Ban any member who they feel is disrupting peace and order on any XMGNetworks.com server related activities by any means that they feel fit, and for any period of time they feel suitable.
10. Regarding forums Forums are allowed. However, the registered user must have a website hosted under the same account to go along with it. Content Management Systems are allowed to be used for websites.
11. Acceptance of Liability Users who participate in our Service Accept complete Liability for their Actions on our Servers.
12. Ad-Supported Services Users who on hosted by our Ad-Supported plans MUST display ads issued by XMGFree.com on every page of website. Ad-Codes can be found here. Failure to comply will result in suspension and/or termination of our provision of services to that user. XMGNetworks.com Reserves the right to change the ads on your site once they are initially placed, as our ad providers change periodically.
